Beta Terms of Use

Version 1.0 (draft) · Effective from 31 October 2026

Draft. These terms are pending legal review and may change before the beta opens more widely. We'll email you if they change.

Plain-English summary

  • Ember is a free beta. It's useful, but it's unfinished: things will change, break, and occasionally be wrong.
  • Your data is yours. We use it only to run Ember for you, as set out in our Privacy Policy.
  • Ember gives you information about your own money, not financial advice. Check anything important against your bank.
  • You can leave any time and take your data with you. We can end the beta too, with notice.
  • Your rights under Australian Consumer Law still apply. Nothing here takes them away.

1. Who we are and what these terms cover

Ember is operated by EmberFI Pty Ltd (ACN 700 035 089) (“we”, “us”). These terms apply when you use Ember: the web app, the Ember inbound email address, and any connector that lets another app read your Ember data. By signing in, you agree to them. If you don't agree, please don't use Ember.

Our Privacy Policy explains how we handle your personal information and forms part of these terms.

2. The beta

Ember is in a private beta. During the beta:

  • Ember is free. If we introduce a paid plan, we will tell you in advance, and you won't be charged unless you choose to sign up for it.
  • Features may be added, changed or removed, sometimes without notice.
  • Ember may be unavailable at times, and may contain errors.
  • We may ask you for feedback. You don't have to give it.

3. Who can use Ember

You must be at least 18 and able to enter into a binding agreement. You must give us an email address you control and keep your sign-in secure. You're responsible for what happens under your account, unless it's caused by our failure to take reasonable care.

4. Households

If you invite a partner into your household, they can see the household's shared accounts and transactions, and the summaries Ember builds from them. Only invite people you're happy to share that with. You can manage household members in Settings.

5. Your data

  • It's yours. You keep ownership of everything you put into Ember.
  • What we do with it. You give us permission to store, process and display your data, and to send it to our service providers (including AI processing), only so far as needed to provide Ember to you and as described in the Privacy Policy. We don't sell it.
  • Your bank is the source of truth. Ember works from the files and emails you give it. Keep your own records; Ember isn't a backup of your banking history.
  • Leaving. You can export your data and close your account at any time in Settings.

6. Not financial advice

Ember shows you information about your own spending, income and plans: categories, trends, forecasts, a “safe to spend” estimate, and answers from Ember AI. This is general information, not financial product advice. It doesn't take into account your objectives, financial situation or needs. Forecasts and estimates are based on your past transactions and can be wrong. Before making a financial decision, consider whether it's right for you, check the figures against your bank, and get advice from a licensed professional if you need it.

7. AI features

Ember uses AI to categorise transactions, to answer questions in chat, and to prepare insights. AI output can be incomplete or wrong, even when it sounds confident. Ember never moves money, and changes it proposes to your records or plan are applied only when you confirm them. You're responsible for checking anything you rely on.

8. Acceptable use

Don't:

  • upload data you don't have the right to use (for example, someone else's bank records without their permission);
  • try to access other people's data, probe or break Ember's security, or interfere with how it runs;
  • reverse engineer Ember, or scrape it by automated means other than the connectors we provide;
  • use Ember for anything unlawful, or to harass or harm anyone;
  • try to make Ember's AI produce harmful content or reveal how it's built;
  • resell or share access to Ember.

9. Feedback

If you send us ideas or feedback, we can use them to improve Ember without owing you anything. We won't publish your name or your data in connection with it without your permission.

10. Beta: no promises

To the extent the law allows, Ember is provided “as is” during the beta. We don't promise that it will be uninterrupted, error-free, or that data can never be lost. We take reasonable care, but you should keep your own records.

11. Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, that you have under the Australian Consumer Law or other law and that can't lawfully be excluded, restricted or modified.

12. Limits on our liability

To the extent the law allows, and subject to section 11:

  • we are not liable for indirect or consequential loss, or for loss arising from decisions you make based on information in Ember;
  • our total liability to you in connection with Ember is limited to AUD $100.

These limits don't apply to liability that can't be limited by law, or to loss caused by our fraud, wilful misconduct, or breach of our privacy obligations.

13. Ending the beta or your access

  • You can stop using Ember and close your account at any time.
  • We can end the beta, or your access to it, by giving you at least 30 days' notice by email, so you have time to export your data.
  • We can suspend or end your access immediately if you seriously breach these terms, or if it's needed to protect Ember's security or other users. Where it's safe to, we'll tell you why and let you export your data.

When your account closes, your data is deleted as described in the Privacy Policy.

14. Changes to these terms

We may update these terms. For a material change, we'll email you at least 14 days before it takes effect. If you keep using Ember after that, the new terms apply; if you don't agree, you can close your account.

15. General

  • These terms are governed by the law of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth courts sitting there.
  • If part of these terms is unenforceable, the rest still applies.
  • If we don't enforce a term straight away, we can still enforce it later.
